Command responsibility
States are to ensure that they comply with and respect human rights standards and the laws of war. Regardless whether they or their agents are engaged in a (non-) international armed conflict.
Upon infringement of these obilgations, states are obliged to cease their unlawful actions and restore the respect for these standards. If and when they are reluctant to do so, they will face counter measures from the international community as well as legal consequences and shall be liable to provide reparations and legal remedies to victims.
