By law we are obliged to maintain a privacy policy. This policy describes which personal data is being collected, for what purposes they are being handled and how they are stored and protected.

INTRODUCTION

As of 25 May 2018, the EU General Data Protection Regulation (GDPR) applies within the EU. Gather4Humanity ("we") comply  with the GDPR and work hard to ensure the proper collection, storage, handling and protection of all personal data that we use.


Article 1. Company details and contact information

Gather4Humanity is a company established under Dutch law, and registerd at the Chamber of Commerce under number 76105105. We are responsible for the collection, handling, storage and protection of your personal data in accordance with this privacy statement. We can be contacted at info@gather4humanity.com.


Article 2. Scope

This privacy statement applies to our website, community and all related products and/or services. By using any of them, you agree that we collect, store, handle, share and protect your personal data in accordance with our privacy policy. We therefore advice you to read our privacy statement and to use it in order to make informed decisions. 


Article 3. Personal data

Personal data refers to any information that can be traced back to a person. This information could be your name, address, location, but it may also refer to your bank account number, telephone number, stored cookies, etc.


Article 4. Principles 

With regard to the collection, storage, handling and protection of personal data Gather4Humanity adheres to the following GDPR guidelines:

  • We collect as little personal data as possible
  • We ask your permission for the use of your personal data 
  • We explain why we need your personal data  
  • We explain that we will not use your personal data for purposes other than mentioned in our privacy statement 
  • We make sure that no personal data falls into unauthorized hands
  • We destroy or anonymize personal data once the activity for which they were collected has been completed


Article 5. Extraordinary (sensitive) personal data

Information about, amongst others, race, religion, political affiliation, criminal background, or health are called extraordinary (sensitive) personal data. Gather4Humanity does not collect, store or handle this type of information from its customers.   


Article 6. Minors

Gather4Humanity has not the intention to collect personal data about digital visitors under the age of 16, except with the consent or their parents or guardians. We can however not distinguish visitors under the age of 16. We therefore advice you to be engaged in the online activitities of children under your protection. This to ensure that no personal data is shared without legal consent. If you have reasons to believe that we have nevertheless obtained and stored personal data of a visitor under the age of 16, please contact us. We will  delete all collected, stored and handled information.


Article 7. Collection and storage of personal data 

The collection and storage of personal data is necessary to comply with our mutual contractual obligations, to deliver our products and/or services, to protect our lawful rights and/or to comply with our financial and legal obligations. They are collected upon your or your compagnies  consent and can be withdrawn at any given moment in time. Personal data that we may need or that are necessary for the described purposes are:

  • Surname
  • E-mail address


Paid products and/or services

  • First name
  • Surname
  • Company name
  • Contactperson (first name, surname, position)
  • Address
  • Phonenumber(s)
  • E-mail address
  • Bankaccount
  • Internetbrowser, locations and  type of device
  • Registration information
  • Additional personal data that is actively provided by you, for instance by setting up a personal profile, in correspondence or by phone
  • Data about your activities in regard to our products and/or services  


Article 8. Purposes for the handling of personal data

As stated and in general, the collection and storage of personal data is necessary to comply with our mutual contractual obligations, to deliver our products and/or services, to protect our lawful rights and to comply with our financial and legal obligations. Unless we have your consent, we will not handle your personal data for purposes that are not in accordance with and/or described in this privacy statement. 


We handle your personal data for the following purposes: 

  • Sending our newsletter and/or, conditional on your consent, additional mailings
  • To register an account with us
  • Handling of quotations, payments and transactions 
  • To call or mail you when  neccesary to provide access to or deliver our products and/or services
  • To inform you about changes in our products and/or services
  • For statistical and analytcal reasons in order to adjust our products and/or services to your preferences or to optimize the customer experience. Your personal data is then anonymized and can no longer be related to an individual person 
  • To comply with our legal responsibilities and obligations
  • To prevent, combat and respond to fraud
  • To optimize our offerings
  • Any additional reason to serve you as a customer in a timely, efficient and just way 


Article 9. Storage

Gather4Huimanity stores your personal data no longer than requirred to fulfil our obligations, to settle disagreements and/or for as long as requirred under the purposes mentioned in this privacy statement. Upon storage we take into consideration the type of information that is collected and the purpose for which it was collected. We do so in order to meet obligations and to delete old, unused and inaccurate personal data as soon as possible. 


Duration:

  • Personal data: for as long as you use our products and/or services 
  • Address: for as long as you use our products and/or services and for as long as we are legally obliged   
  • Under Dutch tax law, customer information needs to be archived for 7 years 


Article 10. Protection

Gather4Humanity takes into consideration that you put your trust on us. Therefore we feel a great responsibility to ensure your personal data is secure with us, handled properly and  with the greatest amount of confidentiality. In this privacy statement we therefore explain which personal data is being collected, for what purposes they are being handeld and how they are stored and protected. We aim to be fully  transparant in our handling of your personal data. Your personal data is stored on secured servers, be it with us or with third parties. Gather4Humanity takes precautions to protect your personal data against loss, wrongdoing, unlawful access and/or unlawful handling. We have, amongst others, the following technical and administrative precautions in place:


  • All persons working for Gather4Humanity are bound by adhering to this privacy statement and to respect confidentiality with regard to your personal data, unless they are under a legal obligation to share information
  • Logical access control, usage of passwords and possibly a second factor
  • Encryption of data
  • Pseudonimizing  data
  • The usage of  Virtual Private Servers (VPN) accessible by  SSH-key
  • Transfer over SSL
  • Purpose bound restrictions
  • Control of acknowledged autorisations


In the circumstance that you may have indications that personal data is being abused, please contact us. Although Gather4Humanity does it utmost, we can not be held responsible for unlawful actions or abuse by persons that obtained unlawful access to your personal data. We can not explicitly, implicitly or otherwise guarantee that we can prevent unlawful access.  


Article 11. Your rights

You have the right to insight in your personal data that we store and handle. You may at any given time request us to:

  • confirm whether we collected, stored or handeld your personal data
  • if so, which personal data
  • to share a copy of all collected, stored and handled personal data
  • to alter or delete your personal data
  • object the collection, storage or handling of your personal data
  • file a complaint with the supervisory organisation

  

Upon request for a copy of your personal data, we will verify your identity by asking for an identity card or passport. We kindly ask you to anonymize the Machine Readable Zone (the zone with numbers at the bottom of a passport), the documentnumber and your fiscal number. If you have reasons to believe that the given information that we handle is not correct, you may ask us to update the stored personal data. We shall provide prompt and reasonably quick reactions to all your requests. This, in accordance with the GDPR. Please contact us when you feel dissatisfied with our response to any request you made.

Article 12. Sharing with third parties

Gather4Humanity shall not share your personal data with third parties, unless this results from executing our agreement with you or your organisation or to adhere to legal obligations. In all other cases we need your consent. For its products and/or services Gather4Humanity relies partly on digital solutions of third parties, these are:

- Antagonist, our webhost

- ActiveCampain for our e-mail campaigns and newsletter

- Phoenix website, our main channel for presenting ourselves

- Huddle community, to gather like-minded in a trusted environment

- Plug&Pay and Mollie, for the processing of payments

- Snelstart, our accounting program to comply with tax rules and regulations

- Airtable, for Customer Relations Management purposes


In all these instances, Gather4Humanity ensures that your personal data receives the same level of protection and confidentiality.

Under all  circumstances, Gather4Humanity remains responsible for the handling of your personal data.  


Article 13. Transferring outside the European Economic Area

In order to fulfil the purposes as described in this privacy statement, we may transfer your personal data ouside the European Economic Area. When this is the case, Gather4Humanity will take suitable meassures to ensure that your personal data remains protected and that we only transfer your personal data to a country that is being recognised by the European Commission for meeting the appropriate criteria for (personal) data protection. 


Article 14. Websites and services of third parties

Our privacy statement applies only to how Gather4Humanity collects, stores and handles obtained personal data from its own customers. If you share personal data with third parties or on other sites, other privacy policies may apply, albeit  websites of third parties linked with our products and/or services. Therefore we refer and advice you to read their privacy statement. We can not guarentee that third parties deal with your personal data in an appropriate, safe and truthworthy way.


Article 15. Decisions based on automized handling 

Gather4Humanity does not make decisions based on automized handling of personal data that can have significant impact on persons.


Article 16. Cookies

Gather4Humanity and its partners use technical, functional and analytical cookies that do not infringe with your privacy. A cookie is a small file that is being stored on your device. Cookies enhance  the possibility to interact, store your preferences, support the proper functioning of spamfilters, video performance and caching and serve the overall performance and speed of the website. Cookies allow our systems to recognize your webbrowser. They are helpful, since they will enable the user to navigate efficiently, and to  avoid a situation by which you have to re-enter personal data, preferences, placing products and services in the basket or to readjust your settings. Cookies are aimed to provide you relevant and personal information that you can them obtain in a user friendly way. In this way we are able to improve the functioning and experience or our products and/or services and can we learn from customer behaviour. The opt-in formats use functional cookies. This is done to preserve the session and to remember the steps of the request without losing previously provided data.  


Our products and/or services may use the following cookies:

1) Session cookies; will only be stored temporarily during an internetsession in order to guarentee normal usage of the system. These cookies will be deleted afer closing the browser;

2) Permanent cookies; will only be read by the site, are stored on your computer for a limited time and will not disappear after closing the browser. These cookies are being used for repetitive use of our site and we need to know who you are in order to, for instance, set your preferences right;

3) Cookies of third parties; that are being installed by other online services that are responsible for content on a page that you visit, for instance external compagnies that analyse or check our access to the web.


We use cookies to improve the user experience, to gain insights on customer behaviour and to improve our products and/or services. They allow us to register for instance on which day or hours customers visit our site, which pages they visit and how often they visit the site. The information obtained will not be linked to your personal data and are subject to the terms of use and privacy policies of the solution that we may use.  


Cookies do not contain information that can be used to identify the user, but the personal data that we store can be linked to information that is stored by and retrieved from cookies.  You delete or disable  cookies by modifying your internetbrowser in such a way it does no longer store cookies. Furthermore, you can delete all previously stored information via the settings of your browser. It is possible however that your webexperience will be different and/or that some of our services and functionalities do no longer function if you disable cookies. 

 

Your  IP-address can be stored in the logfiles of our  webserver if you use our website and/or community or related services. This is nessecary for a proper functionality and for protection purposes. We do not use your IP-address outside the scope of our products and/or services. In most cases we are not capable to link your IP-address to your name, address or other identifiable information, unless you provide such information and keep using the same IP-address.  


Article 17. Unsubscription

All digital products and/or services like mailings contain the opportunnity to  unsubscribe. 


Article 18. Social media

Gather4Humanity uses social media channels to connect with, inform, empower and inspire the public about trends, information, developments and our products and/or services. You may follow us on Facebook, LinkedIn and Twitter. By using these channels, you agree to the conditions of the respective platform. We have no influence on what personal data is used or handled by the respective platforms. You may wish to read these conditions and to adjust your personal settings to your preferences.  


Article 19. Applicable law and adjustments

Upon handling personal data, Gather4Humanity has to comply with applicable law and legislation. We therefore commit ourselves to keep track of (new) developments and requirements and adjust our privacy statement accordingly. Furthermore, this privacy statement is tailored for our products and/or services. Adjustments in any of these, just as under legal obligations, may lead to an update of our privacy statement. You may therefore regularly want to check our privacy statement. You will find the date of the latest changes in the top of this statement. Using any of our products and/or services  you agree that we collect, store, handle, share and protect your personal data in accordance with our (adapted) privacy policy

Gather4Humanity pays due attention to the content of its products and/or services and this privacy statement. We can however not guarentee that all information provided is constantly accurate and complete.
