Closed preliminary examinations

Honduras

On 28 October 2015, based on thorough legal and factual analysis of the information available, it was concluded that there is no reasonable basis to proceed with an investigation, and it was decided to close the preliminary examination.

Korea

On 23 June 2014,it was concluded that the requirements to seek authorisation to initiate an investigation of the situation in the Republic of Korea had not been satisfied.



Registered vessels

On 29 November 2017, having carried out a thorough review of all the submissions made and all the information available, it was decided that there was no reasonable basis to proceed with an investigation.


Closed preliminary examinations - continued

Iraq/UK

On 9 December 2020, it was decided not to request the opening an investigation. It was  concluded, following a thorough examination, that none of the potential cases arising from the situation would be admissible before the ICC at the present time.  


Gabon

On 21 September 2018, it was concluded that the information available did not provide a reasonable basis to believe that, in the context of the 2016 post-election violence in Gabon,  members of the opposition or the Gabonese security forces, committed crimes against humanity or the crime of incitement to genocide.

Orders for reparations

Mali

Ahmad al-Faqi al-Mahdi

Mr Al Mahdi is liable for 2.7 million euros in expenses for individual and collective reparations for the community of Timbuktu for intentionally directing attacks against religious and historic buildings in that city.


Reparations were ordered for three categories of harm: damage to the attacked historic and religious buildings, consequential economic loss, and moral harm.

366 victims participated in the case


On 24 March 2017, an order for reparations was given in the amount of $1,000,000 USD.


Comprising of an individual symbolic compensation award of $250 to each victim and of four collective awards to all victims, in the form of housing assistance, education assistance, income generating activities, and psychological rehabilitation.

DEM. REPUBLIC OF CONGO  

Thomas Lubanga Dyilo

 427 persons were recognized as victims


On 15 December 2017, mr. Lubanga’s liability for collective reparations was set at USD $10 million to reflect the harm suffered by victims.


Comprising of symbolic and service-based collective reparations:  the construction of three community centres and the launch of a mobile programme featuring activities to the reduce stigma/discrimination of former child soldiers. For the service-based collective reparations, a plan was approved to provide physical/psychological rehabilitation, vocational training and income-generating activities.
